With police still on the scene in Sheepshead Bay on Monday night of the deadly shooting involving one of their own, authorities released a picture of the fake gun used by the suspect, a toy that helped bring the man's life to an end.

On the streets, there was no second guessing on the police decision to fire a weapon.

"Since he didn't put down the gun they didn't know what else to do," said witness Louis Benz of Sheepshead Bay."

"They probably didn't know it was fake so what else, they probably did what they had to do," added Serg Sarukhanyas.

The deadly chain of events ended Monday afternoon just outside P.S. 194. It began, a police source said, in a public housing complex where the suspect was waving his imitation around. After a 911 call, an officer approached the man, who then ran.

A police source told CBS 2 HD the chase went all the way down a sidewalk with the officer yelling to the suspect, "drop your weapon, drop your weapon." CBS 2 HD was told the chase only ended when the suspect spun around with his object in view.

Students getting out of school then learned first hand what the police use of force can lead to.

"All I hear is the first gunshot. I look over, and right next to the school I see the police officer shooting," witness Rahman Amer said.

"I come running out and I see the cops over there and there was a body in the middle of the street," witness Maureen Quinn added.

With gunshot wounds to his neck and chest, the 22-year old died at the hospital.

John Jay College criminologist Maria Haberfeld said the suspect shouldn't have expected anything else from police.

"The police officers have no obligation to find out whether the gun is real or a toy," Haberfeld said. "You're talking about seconds, proverbial nanosecond decisions that you have to make. There isn't really any time to try to figure out maybe it's not real because it's your life on the line or somebody else's for that matter."

Neither the suspect nor the officer involved have been identified. Police did not say whether the officer would be back on duty on Tuesday. Typically when an officer is involved in a deadly shooting he or she is taken off the street until that shooting has been fully investigated.

DENVER – Amazon.com Inc. cut ties Monday with Colorado online businesses that help it sell products because of a new state law aimed at getting out-of-state, online retailers to collect sales tax.

The move hurts businesses — many of them small, home-based operations — that earn money by using their Web sites and blogs to link customers to online retailers. Colorado has at least 4,200 such businesses, known as affiliates or associates, accounting for about 5,000 jobs, and most of them rely on Amazon to some degree, according to their trade group, the Performance Marketing Association.

The group's executive director, Rebecca Madigan, said some get only about 10 percent of their revenue from Amazon but others are totally reliant on it.

Colorado's largest affiliate, ShopAtHome.com, works with 5,000 online merchants and will be able to recover from the lost business, president Marc Braunstein said. But many "mom and pop" affiliates will suffer.

"There are a lot of people who are going to be hurt, and that's a shame," Braunstein said.

In an e-mail to affiliates, Amazon said the new sales tax regulations, which took effect last week, were burdensome and unlike rules in any other state. An Amazon spokeswoman declined to elaborate.

The company previously cut off affiliates in two other states that passed online sales tax laws, Rhode Island and North Carolina. Those states said online retailers had a presence there through affiliates and therefore had to pay sales tax. At the urging of affiliates, Colorado lawmakers took a different approach that attempted to leave affiliates out of the fight.

The law here says retailers can either collect sales tax or send customers an annual statement telling them how much they spent and how much sales tax they should pay the state on their own. The state would be able to force retailers to turn over customer sales records to enforce the law.

Democratic lawmakers, including Gov. Bill Ritter, criticized Amazon for cutting off affiliates, with some calling it "corporate bullying." They said Amazon will still be on the hook to either collect the tax or tell their customers to pay it.

"They've done nothing here but spit in our face," Senate Majority Leader John Morse said.

Braunstein said he was also puzzled by the move and wondered if the company was trying to make some kind of point.

Republican lawmakers, who opposed the online sales tax bill and other tax hikes to balance the budget, criticized Democrats for pushing ahead with it.

"It's exactly what we said would happen. They're going to put people out of work. It's a game of chicken with people and their jobs, and they lost," said House Minority Leader Mike May, R-Parker.

Sen. Greg Brophy, R-Wray, said lawmakers should move to repeal the law.

"Their actions have had real-life consequences for real-life Colorado citizens," he said.

Many affiliate marketers are either unsuccessful or only partially successful because they tend to lack focus. They go from one strategy to another without really taking the time to master anything. Japan says it won't comply with possible tuna ban

TOKYO – Japan will not comply if a ban is imposed on international trade in Atlantic bluefin tuna, prized by Japanese for sushi, a senior official said after the United States threw its support behind the move ahead of a crucial vote.

"If worse comes to worst, Japan will inevitably have to lodge its reservations," Vice Fishery Minister Masahiko Yamada told a news conference Thursday.

His comments came a day after the United States threw its support behind the ban on the international trade in Atlantic bluefin tuna, which conservationists say risks extinction if current catch rates continue.

At a March 13-25 meeting in Qatar, 175 member countries of the Convention on International Trade in Endangered Species of Wild Fauna and Flora, or CITES, will vote on a proposal by Monaco to list the species under Appendix 1 of the convention. If the measure wins support from two-thirds of member nations, trade of the fish would be banned.

Environmentalists say that would significantly reduce the catch because 80 percent of all Atlantic bluefin ends up in Japan, where it is a key ingredient in sashimi and sushi. Fatty bluefin — called "o-toro" here — can go for as much as 2,000 yen ($22) a piece in high-end Tokyo restaurants.

But Japan may register a reservation on the ban, which in practical terms means it could engage in trade with any other nation that also files a reservation.

The impact of such a move remains unclear because it depends on how many other nations might also register reservations. But activists say it could seriously undermine any ban.

"If major fishing nations show the same position as the Japanese government, it will ruin the concept of the CITES treaty," said Wakao Hanaoka, an ocean campaigner with Greenpeace in Tokyo.

Bluefin tuna stocks in the Eastern Atlantic and Mediterranean have dropped by 60 percent between 1997 and 2007, a result of surging demand as well as illegal and underreported catches.

The upcoming CITES vote is starting to garner more attention in Japan, with TV programs saying a ban would make it much harder for Japanese to obtain the succulent red and pink tuna meat. Other tuna species, including the Pacific bluefin, bigeye and yellowfin, would not be affected by the ban.

Yamada said Japan is committed to protecting bluefin species. Tokyo believes that catch quotas, which have already been cut 40 percent this year to 14,900 tons (13,500 metric tons) by another body, the International Commission on the Conservation of Atlantic Tuna, should be sufficient.

But environmentalists say the quotas are widely ignored and are too high anyway.

The European Commission has proposed that EU governments commit to the ban, although there still appears to be some division. Greece, Malta, Spain and Italy — which have strong fisherman lobbies — have resisted steps to curtail the hunt for bluefin, but recently France signaled it would support a trade ban if its implementation were delayed.

"If worse comes to worst, Japan will inevitably have to lodge its reservations," Vice Fishery Minister Masahiko Yamada told a news conference Thursday.

But Japan may register a reservation on the ban, which in practical terms means it could engage in trade with any other nation that also files a reservation.

The impact of such a move remains unclear because it depends on how many other nations might also register reservations. But activists say it could seriously undermine any ban.

"If major fishing nations show the same position as the Japanese government, it will ruin the concept of the CITES treaty," said Wakao Hanaoka, an ocean campaigner with Greenpeace in Tokyo.

Bluefin tuna stocks in the Eastern Atlantic and Mediterranean have dropped by 60 percent between 1997 and 2007, a result of surging demand as well as illegal and underreported catches.

But environmentalists say the quotas are widely ignored and are too high anyway.
